Following an appearance by Linsday Lohan's attorney Mark Heller at the Manhattan Criminal Court Monday morning, there has still been no formal complaint filed against the actress for allegedly assaulting another woman at a New York nightclub.

Lohan was arrested?in late November after?she allegedly got into a confrontation at Avenue, a Manhattan night spot. At the time, Heller said that Lohan was?the "victim of someone trying to capture their 15 minutes of fame."
After making an appearance at the court clerk's office Monday, Heller told TODAY.com that Lohan's appearance was not neccesary because there was still?no?accusatory document filed with the courts.?If and when there is a document,?he'll be pleading?"not guilty" on behalf of his client, he said.?"The D.A. is still assessing the matter," Heller said. "I've been working closely with them and I'm hopeful that I'll be able to have Lindsay exonerated."
Heller expects to be notified in the coming days about a future court date.
Heller added that things are already looking up for his client. "A psychic fortune teller has told Lindsay that 2013 will be extremely lucky for her. And that?s all she needs, just a little luck on her side."
For her part, Lohan has kept a fairly low profile recently. She tweeted a New Year's eve message, saying she was "blessed" and "grateful," and only a handful of photos?of her were snapped recently in London.
